Where these cases are brought by local authorities, for example seeking a care order, they are known as public law proceedings. When the dispute is within a family, for example over how frequently a separated parent should see a child the case is known as private law.
Most of the funding of these cases is from the legal aid scheme. In some cases such as care proceedings funding is free of charge. In other cases an assessment of means is required to ascertain eligibility and the applicant must show that it is in the interest of justice that public funding be granted.
